利用規約（EULA）
本利用規約（以下「本規約」）は、お客様と「Omokage（面影）」（以下「本アプリ」）の開発者（以下「当方」）との間のエンドユーザーライセンス契約（EULA）です。本アプリをダウンロードまたは使用した時点で、本規約に同意したものとみなされます。本規約はAppleの標準EULA（Licensed Application End User License Agreement）を基礎としており、本規約に定めのない事項についてはAppleの標準EULAが適用されます。
1. ライセンス
当方は、App Store利用規約で認められる範囲において、お客様が所有または管理するApple製デバイス上で本アプリを使用するための、個人的・非独占的・譲渡不能・取消可能なライセンスをお客様に付与します。法令で認められる場合を除き、本アプリの複製、改変、リバースエンジニアリング、再配布、転売はできません。
2. 利用できる写真と禁止事項
本アプリで加工してよいのは、お客様ご自身が権利を有する写真に限られます。第三者の肖像を含む写真を、その方（またはその権利を持つ方）の同意なく加工しないでください。
お客様は、本アプリを用いて以下の行為を行わないことに同意します。
- 他人へのなりすまし、または実在の人物について事実と異なる印象を与える表現の作成。
- 他人の名誉・信用を毀損し、または侮辱・中傷する目的での利用。
- 性的・わいせつなコンテンツの作成。
- 他人の肖像、または故人の肖像を、権利を持つ方の同意なく商用目的で利用すること。
- 法令、公序良俗、または第三者の権利（肖像権・著作権・プライバシー等）を侵害する利用。
故人・ご遺族への配慮: 本アプリは、大切な方の古い写真を尊厳をもって扱うことを想定して設計されています。故人の写真を扱う際は、ご遺族をはじめ関係する方々の心情に配慮し、故人の尊厳を損なうような加工や利用を行わないでください。
3. AIによる補正に関する免責
本アプリのAIは、元の写真を学習データに基づいて推定・補正するものです。失われた情報を忠実に復元できるとは限らず、仕上がりは元写真の解像度・状態によって異なります。顔の細部はAIが自然に見えるよう補完するため、実際とわずかに異なる場合があります。
本アプリは「盛る」ためのものではなく、写真を無理なく鮮明にするためのものです。仕上がりが元の印象と異なると感じられた場合は、強度スライダーや顔ごとの適用切り替えで調整できます。仕上がりの確認と最終的な判断は、お客様ご自身の責任で行うものとします。
4. 課金・購入
- 本アプリは、AppleのApp Storeを通じて、消耗型の課金アイテム「書き出し1枚分の権利」（¥320 / $1.99・1枚の書き出しにつき1クレジットを消費）と、非消耗型（買い切り）の「無制限プラン」（¥2,000 / $13.99・書き出し無制限）を提供します。サブスクリプション（自動更新）は提供していません。価格は購入前にアプリ内に表示されます。
- 消耗型クレジットは、購入完了時に付与され、書き出し（保存）が成功した時点で1クレジット消費されます。処理中の中断や保存の失敗があった場合、クレジットは消費されません。
- 消耗型クレジットの引き継ぎについて: 消耗型の書き出しクレジットは、Appleの消耗型アイテムの仕組み上、同一端末での再インストールには耐えますが、機種変更では引き継がれません。また「購入の復元」の対象にもなりません。機種変更・端末の移行の前に、お手持ちのクレジットは書き出しに使い切ることをおすすめします。
- 無制限プランの復元について: 「購入を復元」で復元されるのは非消耗型の無制限プラン（¥2,000 / $13.99）のみです。同じApple Accountであれば、機種変更後や再インストール後も復元できます。
- 返金について: 決済および返金の手続きはすべてAppleが取り扱い、当方独自のポリシーはなく、Appleのポリシーに従います。当方側で返金を行うことはできません。返金のお申し出はAppleのreportaproblem.apple.comから行ってください。
5. プライバシー
本アプリは写真・顔データを含むいかなるデータも収集しません。すべての処理は端末内で完結します。詳細はプライバシーポリシーをご覧ください。
6. 担保の否認
本アプリは「現状有姿（AS IS）」かつ「提供可能な状態（AS AVAILABLE）」で提供されます。当方は、商品性、特定目的への適合性、権利非侵害を含め、明示・黙示を問わず、本アプリに関するいかなる担保もいたしません。本アプリが中断なくエラーなく動作すること、およびAIによる補正結果が常に正確であることを、当方は約束するものではありません。
7. 責任の制限
適用法令が許容する最大限の範囲で、当方は、間接損害、付随的損害、特別損害、結果的損害、懲罰的損害その他本アプリの使用または使用不能から生じる損失について、責任を負いません。当方の責任の総額は、請求に先立つ12か月間にお客様が本アプリに対して支払った金額を上限とします。ただし、消費者契約法その他の強行法規により制限できない責任については、この限りではありません。
8. 本アプリおよび本規約の変更
当方は、本アプリおよび本規約を随時更新することがあります。重要な変更は、本ページに掲載し、制定日（改定日）を更新することでお知らせします。変更後に本アプリの使用を継続した場合、変更に同意したものとみなされます。
9. 準拠法・管轄
本規約は日本法に準拠し、日本法に従って解釈されます。本規約に関する紛争については、消費者保護に関する強行法規の定めがある場合を除き、日本の裁判所を専属的合意管轄裁判所とします。
10. Appleが第三受益者であること
AppleおよびAppleの子会社は本規約の第三受益者であり、本規約を執行する権利を有することにお客様は同意します。Appleは本アプリに関する保守・サポートを提供する義務を負いません。サポートは当方が提供します（下記参照）。

Terms of Use (EULA)
These Terms of Use ("Terms") are an end user license agreement (EULA) between you and the developer of Omokage ("Omokage," "the app," "we," "us"). By downloading or using the app, you agree to these Terms. These Terms are based on, and incorporate the protections of, Apple's standard Licensed Application End User License Agreement; where these Terms are silent, Apple's standard EULA applies.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Omokage on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse engineer, distribute, or resell the app except as permitted by law.
2. Photos You May Use, and Prohibited Uses
You must own the rights to any photo you edit. Do not use this app to impersonate, defame, sexualize, or misrepresent any real person, and do not edit a photo containing someone else's likeness without the consent of that person (or of the rights holder).
You agree not to use the app to:
- impersonate another person, or create a misleading impression of a real person;
- defame, insult, or harm the reputation of another person;
- create sexual or obscene content;
- make commercial use of another person's likeness, or of a deceased person's likeness, without the consent of the rights holder;
- infringe any law, public order, or the rights of others (including portrait rights, copyright, and privacy).
Respect for the deceased and their families: This app is designed for treating a loved one's old photograph with dignity. When working with a photograph of someone who has passed away, please be considerate of their family and others close to them, and do not edit or use the photo in any way that would diminish that person's dignity.
3. Disclaimer Regarding AI Enhancement
This app uses AI to enhance and reconstruct photos based on learned patterns. It does not guarantee a faithful restoration of lost detail, and results vary depending on the quality and condition of the original image. Facial details are AI-generated to look natural and may differ slightly from the actual subject.
The app is meant to bring a photo back into focus, not to embellish it. If a result feels different from the original, you can adjust it with the strength slider or by toggling enhancement on a per-face basis. You are responsible for reviewing and confirming the final result.
4. Purchases
- Through Apple's App Store, the app offers a consumable purchase, "one export credit" (¥320 / $1.99, consuming one credit per successful export), and a non-consumable (one-time) "Unlimited plan" (¥2,000 / $13.99, unlimited exports). There is no subscription and no auto-renewal. Prices are shown in the app before purchase.
- A consumable credit is granted immediately on successful purchase and consumed only when an export (save) completes successfully. If processing is interrupted or a save fails, no credit is consumed.
- Carrying consumable credits over: Under Apple's consumable-purchase model, export credits survive a reinstall on the same device but are not carried over to a new device, and they cannot be recovered with "Restore Purchases." We recommend using up any remaining credits before switching or migrating devices.
- Restoring the Unlimited plan: "Restore Purchases" restores only the non-consumable Unlimited plan (¥2,000 / $13.99). With the same Apple Account, it can be restored after switching devices or reinstalling.
- Refunds: All billing and refunds are handled by Apple, according to Apple's own policy — we have no separate refund policy and cannot issue refunds ourselves. Refund requests are made to Apple at reportaproblem.apple.com.
5. Privacy
Omokage collects no data, including no photo or facial data; all processing happens on your device. See the Privacy Policy.
6. Disclaimer of Warranties
The app is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that AI enhancement results will always be accurate.
7. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any losses arising from use of or inability to use the app. Our total liability shall not exceed the amount you paid for the app in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including under the Japanese Consumer Contract Act.
8. Changes to the App or Terms
We may update the app and these Terms from time to time. Material changes will be reflected on this page with an updated effective date. Continued use of the app after changes take effect constitutes acceptance.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of Japan, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Japan, except where mandatory consumer-protection law provides otherwise.
10. Apple as Third-Party Beneficiary
You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them. Apple has no obligation to furnish any maintenance or support services with respect to the app; support is provided by us (see below).
